Important: please read the terms of this license agreement carefully before downloading and using the Android/iOS app. By downloading or using the Android/iOS app, you indicate your acceptance of this End User License Agreement, and a legally valid agreement regarding the use of the Android/iOS app “CouponCrowd” (hereinafter referred to as the “APP”) is concluded between you, the end user (legal entity or natural person), and Industrial Nerd Ventures UG (limited liability), Hauptstraße 15, 74385 Pleidelsheim (hereinafter referred to as “COUPONCROWD”). This agreement applies to all updates and services provided through the use of the APP, unless such services are subject to other specific terms.
If you do not accept all provisions of this agreement, you have no right to use or download the APP. You must immediately stop using the APP and the services and delete all copies and files of the APP.
The APP is provided by COUPONCROWD for personal, non-commercial use.
Should individual terms or parts of the agreement be invalid, the remaining terms and parts shall remain in force.
COUPONCROWD grants you the non-exclusive, time-limited, non-transferable right to use the APP. No further rights are granted.
In particular, you are not permitted to distribute the APP or otherwise transfer it to third parties, including rental, leasing, lending or sublicensing. You are not entitled to modify the program code of the APP or parts thereof, to determine the source code, including reverse engineering, decompiling or disassembling, or to create derivative works of the APP. However, the mandatory, non-waivable provisions of Sections 69d and 69e of the German Copyright Act (UrhG) remain unaffected.
You are not entitled to use the APP in a way that could damage it or its services, or impair its use by third parties. The user is not entitled to use the services to attempt, in any way, to gain unauthorized access to services, data, accounts or networks.
The APP is provided in its present form (“as is”) without warranties of any kind.
Any warranty claims due to material defects or defects of title in the APP may arise exclusively between you and COUPONCROWD.
COUPONCROWD shall be liable for material defects and defects of title, regardless of the legal basis, only insofar as COUPONCROWD has fraudulently concealed the respective material defect or defect of title. Otherwise, due to the free provision of the APP, COUPONCROWD, its legal representatives and vicarious agents shall only be liable for compensation for any damage incurred in the event of intentional or grossly negligent misconduct. COUPONCROWD also provides no warranty whatsoever regarding the accuracy and timeliness of the information displayed or the products identified. The information displayed by the APP may differ from the information on the merchant’s website. All information and details displayed by the APP are provided without warranty. The listed offers do not constitute binding advertising statements by the providers.
COUPONCROWD allows the end user to link products and offers from third-party sources and manage them in virtual shopping carts. By linking products and offers, these are made available to COUPONCROWD and are deemed “user content”. All rights to the user content linked in the APP, as well as sole responsibility for it, remain with the end user.
For the sole purpose of operating, developing, providing and using the APP, the end user grants COUPONCROWD and its users a non-exclusive, non-transferable, non-sublicensable, royalty-free, worldwide license to use, store, display, reproduce, distribute and create derivative works from the user content.
